TERMS & CONDITIONS - CASA LA CALERA
1.1 These Terms and Conditions apply to all guests of Casa La Calera.
1.2 Casa La Calera consists of a main house including four studio apartments and outdoor areas. The apartments are rented to guests for a short-term period. Casa La Calera is operated by managers, hereinafter referred to as "Casa La Calera". The managers of Casa La Calera can be replaced by representatives.
1.4 The minimum stay at Casa La Calera is three nights.
1.5 Check-in is possible from 15:00 until 23:00. Check-in after 23.00 hours is possible on request and we apply a surcharge of € 25,-. Check-out is possible until 11:00 am on the day of departure. A late check-out (until 18:00) is only possible on request and based on availability. For this we apply a surcharge of € 50,-. There will be no refund for early departures.
1.6 It is not allowed to invite and/or bring unregistered persons who are not officially staying at Casa La Calera into the accommodation(s).
1.7 Pets are not allowed.
1.8 Smoking is not allowed in all apartments and communal indoor areas of Casa La Calera.
1.9 Drugs are not allowed at Casa La Calera. Anyone found in possession of or taking any illegal substance will have their stay terminated without any refund and the matter will be reported to the police without exception.
1.10 You should not cause any noise nuisance both inside and outside your apartment. All guests agree to respect the privacy and peace of all other staying guests and the owners at all times.
1.11 Guests can park their car in the gated private parking area. Parking is always at your own risk.
1.12 In case of not complying with the Terms & Conditions, the house rules or in case of inappropriate behavior,Casa La Calera has the right to deny guests access to the property, without further notice and reasons and without refund of the paid rental fee.
1.13 The website of Casa La Calera has been created with the greatest care, but there may be differences between the text and/or photos presented on the website and the actual situation in and around the (rental) accommodation of Casa La Calera at the time of the guest's visit. No rights can be derived from such differences by guests.
1.14 Casa La Calera reserves the right to change the terms and conditions. You accept and acknowledge as binding the terms and conditions that apply when you use the website and facilities of Casa La Calera.
2.1 The rates shown are per studio apartment, per night and based on an occupancy of two people.
2.2 The rates shown include the statutory VAT, the use of water, electricity and bath and bed linen. The use of air conditioning is excluded, an additional daily rate applies for using the air conditioning.
2.3 The displayed rates include the applicable VAT rate (or similar tax). Should the VAT rate change between the date of the reservation/booking and the date of the delivery of services, according to tax legislation the VAT rate must be applied from the time of the delivery of services or increase of the tax, even in the case that the foregoing results in an increase in the final rental fee/price as communicated to the guest in the initial reservation.
2.4 The rates shown do not include the costs of cancellation or travel insurance. We advise you to take out cancellation and travel insurance.
2.5 The displayed rates are subject to price changes.
3. RESERVATION, CONFIRMATION AND PAYMENT
3.1 A reservation (request) can be sent through the website of Casa La Calera or if applicable, through an official booking site selected by Casa La Calera.
3.2 After receiving your reservation (request), Casa La Calera will request you to arrange the applicable (down) payment of the rental fee. The reservation (request) becomes an official booking and agreement after (down)payment has been received and Casa La Calera has confirmed your reservation.
3.3 The deposit is 50% of the total rental sum and needs to be paid when making the reservation.
3.4 The remaining payment of the total rental sum must be paid no later than 8 weeks before arrival.
3.5 When booking within 8 weeks before arrival, the total rental amount must be paid immediately.
3.6 The down payment and the remaining payment must be made through the payment options available on the website of Casa La Calera. In the case of a bank transfer, the following information must be used: bank account IBAN: ES26 3058 0769 4627 2010 3504,
BIC code CCRIES2AXXX, in the name of Patrick de Vries stating your reservation number.
3.7 The costs for using the honesty-bar and other facilities used during your stay will need to be paid in cash before your check-out.
4.1 Cancellations will only be accepted in writing or by e-mail, stating your reservation number.
4.2 If the booking agreement is canceled, the following cancellation costs will be charged:
4.3 In case of a no-show the full rental/booking fee is due. We advise you to arrange a comprehensive travel and cancellation insurance.
5. FORCE MAJEUR
In the event of force majeure, both of a permanent and temporary nature, Casa La Calera is entitled to terminate the agreement in whole or in part or to suspend it temporarily without the guest being able to claim fulfillment and/or compensation. Force majeure includes, but is not limited to: danger of war, war, insurrection, strikes, boycott, disruptions in the energy circuit, traffic or transport, government measures, scarcity of raw materials, natural disasters and exceptional weather conditions, death of one of the managers or close relatives of the managers, etc., in which case no full or partial fulfillment of the contract can be reasonably and fairly expected by Casa La Calera.
6.1 Casa La Calera cannot be held liable by guests or third parties and takes no responsibility for damages and injuries of guests as a result of staying at Casa La Calera. The guest indemnifies Casa La Calera against claims in this regard. Casa La Calera is not liable for malfunctions in and around the property as interference and loss of power - and water supplies and installations, not or not timely announced construction and/or road works in the vicinity of the property. Casa La Calera is not liable for damage, loss or theft of the guest's personal belongings.
6.2 Casa La Calera can only be held liable for damage due to the gross negligence or negligence of the managers.
6.3 Without prejudice to the provisions of 6 .1 and 6 .2, the liability of Casa La Calera, if and in so far as the accommodation is held legally liable for any reason in relation to the user agreement, is always only limited to direct damage and any form of consequential damage is excluded. The liability of Casa La Calera is furthermore always limited to the maximum amount that the insurer of Casa La Calera will pay in the appropriate case.
6.4 The use of the swimming pool and other facilities at Casa La Calera is at your own risk. Casa La Calera cannot be held liable for personal injury or damage to personal belongings through the use of the facilities.
7.1 The guest must behave properly and use the accommodation in accordance with the reasonable instructions for use given by Casa La Calera.
7.2 The main guest is liable for all damages inflicted to the property of Casa La Calera, including all its facilities, inventory and household effects, as caused by the guest and fellow guests that part of the reservation.
7.3 The guest must immediately report damage to Casa La Calera. In case of repair and or replacement, costs must be reimbursed by the guest.
7.4 In the event of loss of keys, all resulting costs will be charged to the guest.
